1. About These Terms

This document governs your use of rebirthretreat.com.au (the "Site") and all services offered by Rebirth Retreat / Kelly Finnis ("we", "us", "our"), including The Yin Yoga Circle membership, 1:1 Mentorship, retreats, events, and free content such as Deep Drops. By accessing the Site, purchasing a service, or otherwise engaging with us, you ("you", "the Client") agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our services.

2. Definitions

• "Circle" or "The Yin Yoga Circle" means our recurring online yoga membership.
• "Mentorship" means 1:1 mentoring packages offered in 1, 3 or 6-month terms.
• "Retreat" means any in-person retreat we run.
• "Event" means any single-date event, including the Winter Solstice Event.
• "Deep Drops" means our free email newsletter.
• "Content" means all video, audio, written and visual material made available through the Site or the members' portal.

3. Eligibility

Our services are intended for adults aged 18 and over. If you are under 18, a parent or guardian must accept these Terms on your behalf and supervise your participation. We do not knowingly collect personal information from children without guardian consent.

4. Services We Offer

We offer The Yin Yoga Circle membership, 1:1 Mentorship, in-person retreats, single-date events, and the free Deep Drops newsletter. Specific terms and pricing for each offer are displayed at checkout and form part of these Terms in addition to the general provisions below.

5. Health, Physical Practice & Wellbeing Disclaimer

Kelly Finnis and Rebirth Retreat are not medical practitioners, psychologists, psychiatrists, or registered health professionals unless separately and explicitly stated. Yin yoga, shadow work, breathwork, sound healing and related practices offered through our services are educational and wellbeing-oriented. They are not a substitute for diagnosis, treatment, or advice from a qualified medical or mental health professional.

You should consult a doctor before beginning any new physical practice, particularly if you are pregnant, have a pre-existing injury or cardiovascular condition, or any condition that could be affected by physical movement, breathwork, or emotionally intensive practices such as shadow work.

Shadow work and related modalities can surface strong emotions or past trauma. If you have a history of significant trauma, are currently under the care of a mental health professional, or are in psychological crisis, please seek guidance from a qualified professional before participating, and disclose any relevant history to us where reasonably practicable so we can support you appropriately.

If you are in crisis or at risk of harm, please contact Lifeline (13 11 14), Beyond Blue (1300 22 4636), or emergency services (000) immediately. We are not equipped to provide crisis support.

6. Assumption of Risk

Participation in physical movement practices (including yin yoga and breathwork) carries an inherent risk of injury. By participating, you acknowledge this risk and agree that you are participating voluntarily and with full knowledge of that risk. You must stop any practice immediately if you experience pain, dizziness, or discomfort, and seek appropriate medical care.

7. Membership & Subscription Terms (The Yin Yoga Circle)

• The introductory and ongoing prices are as displayed at checkout (currently $11 AUD for the first month, then $44 AUD per month), and are subject to change with notice as set out below.
• Membership automatically renews each billing period until cancelled by you.
• An annual billing option may be offered at checkout for additional savings; once an annual period begins, fees for that period are non-refundable except as required by law.
• You may cancel at any time by emailing hello@rebirthretreat.com.au. Cancellation requests must be made in writing by email — verbal or informal requests (e.g. via social media DM) are not treated as valid cancellation notice. Cancellation takes effect at the end of the current billing period and you retain access until then.
• We may change membership pricing with at least 30 days' notice to active members. Continued membership after a price change takes effect constitutes acceptance of the new price.
• We reserve the right to suspend or terminate membership for breach of these Terms or our Community Guidelines (clause 13).

8. Mentorship Terms

• Mentorship session fees are non-refundable.
• If you need to cancel a scheduled session, you must notify us in writing by email to hello@rebirthretreat.com.au at least 48 hours before the session. We will offer you a new time to reschedule the session — no cash or partial refund is provided in place of rescheduling.
• If you cancel with less than 48 hours' notice, or do not attend a scheduled session ("no-show"), the session is forfeited in full — it will not be rescheduled or refunded.
• Mentorship packages are for personal use only and are non-transferable unless we agree otherwise in writing.
• Mentorship is not therapy or a substitute for professional mental health treatment (see clause 5).

9. Retreat & Event Terms

• Bookings require a deposit and/or full payment as specified at the time of booking.
• Retreats involve travel. You are responsible for your own travel insurance, visas, vaccinations and health preparation, and we strongly recommend comprehensive travel insurance covering cancellation, medical treatment and repatriation.
• Retreat and event dates, itineraries and locations may change due to circumstances outside our control (see clause 18, Force Majeure). Where reasonably possible, we will notify you and offer alternatives.
• Specific cancellation and refund terms for each retreat or event will be provided at the time of booking and form part of these Terms.

10. Payments

All prices are in Australian Dollars (AUD) unless stated otherwise. Payments are processed by third-party payment processors, currently FastPayDirect and/or Stripe. We do not store your full card details — refer to our Privacy Policy for details on how payment information is handled. You are responsible for ensuring your payment details are current; failed payments may result in suspended access until resolved.

11. Cancellations & Refunds

Nothing in this clause limits your rights under the Australian Consumer Law — see clause 15.

• Membership fees already charged are non-refundable, except where required by law.
• Mentorship session fees are non-refundable in all cases. A session cancelled with at least 48 hours' written notice will be rescheduled to a new time (see clause 8); a late cancellation or no-show forfeits the session entirely.
• Retreat and event refunds are governed by the specific terms provided at booking, which will address cancellation windows, partial refunds, and non-refundable deposits.
• If a service is not provided with due care and skill, or is not fit for the purpose for which it was sold, you may be entitled to a remedy under the Australian Consumer Law regardless of the above.

12. Intellectual Property

All Content on the Site and within the members' portal — including video classes, written material, images and branding — is owned by or licensed to Rebirth Retreat and is protected by copyright. You may access Content for personal, non-commercial use only. You may not copy, distribute, publicly perform, sell, or create derivative works from our Content without our prior written permission.

13. Community Guidelines & Acceptable Use

Our Circle and events are intended as safe, respectful spaces. You agree not to: share member-only Content publicly or with non-members; harass, bully or discriminate against other members or facilitators; or use our services for any unlawful purpose. We may suspend or remove access for breach of these guidelines without refund, at our reasonable discretion.

14. Photography, Video & Testimonials

At in-person events and retreats, photography and video may be taken for promotional and archival purposes. By attending, you consent to appearing in such material unless you notify us in writing prior to or at the event that you do not wish to be photographed or filmed, in which case we will make reasonable efforts to accommodate this. If you provide a testimonial, you grant us permission to use it (in full or in part, with attribution as agreed) in our marketing. You may request removal of your image or testimonial at any time by contacting hello@rebirthretreat.com.au, and we will action this within a reasonable time where reasonably practicable.

15. Limitation of Liability

To the maximum extent permitted by law, and subject to your non-excludable rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), our liability for any claim arising from your use of our services is limited, at our option, to resupplying the service or refunding the amount paid for the service giving rise to the claim.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other law that cannot lawfully be excluded.

To the extent permitted by law, we are not liable for indirect, incidental, consequential loss, including loss of profits or opportunity, arising from your use of our services.

16. Indemnity

You agree to indemnify Rebirth Retreat against any loss, damage, cost or liability arising from your breach of these Terms, your negligence, or your unlawful conduct, to the extent permitted by law.

17. Third-Party Links & Services

Our Site and communications may contain links to third-party websites or use third-party platforms, including GoHighLevel, YouTube, Instagram, Facebook, FastPayDirect and Stripe. We are not responsible for the content, policies or practices of third-party services. Your use of those services is subject to their own terms and privacy policies.

18. Force Majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, extreme weather, government action, pandemic, illness, travel disruption, or venue unavailability. Where an event is materially affected, we will act reasonably and in good faith to offer an alternative date, credit, or partial refund where appropriate.

19. Termination

We may suspend or terminate your access to any service for breach of these Terms, non-payment, or conduct we reasonably consider harmful to us, our staff, or other members or clients. You may terminate your membership or engagement at any time in accordance with the relevant cancellation terms above.

20. Dispute Resolution

If a dispute arises, please contact us first at hello@rebirthretreat.com.au so we can attempt to resolve it informally. If unresolved, either party may refer the matter to mediation before pursuing formal legal proceedings, without limiting either party's right to seek urgent relief.

21. Governing Law

These Terms are governed by the laws of Western Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia.

22. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.

23. Changes to These Terms

We may update these Terms from time to time. The "last updated" date at the top reflects the most recent revision. Continued use of our services after changes take effect constitutes acceptance of the updated Terms. We will notify active members by email of any material changes.
